Terms of Service

1. Acceptance of Terms

By accessing or using SafetyKit ("the Service," "we," "our," or "us") at safetykit.io, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these terms.

2. Description of Service

SafetyKit provides a suite of workplace safety administration tools for creating, managing, and exporting safety documents and templates. The Service is offered via subscription on a Software-as-a-Service (SaaS) basis. Features available to you depend on your subscription plan. We reserve the right to modify, suspend, or discontinue any feature at any time with reasonable notice.

IMPORTANT: SafetyKit tools are for administrative tracking purposes only. They are not a substitute for professional safety engineering advice. Consult qualified safety professionals before relying on generated documents for safety-critical decisions.

3. Accounts

You must create an account to use SafetyKit. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activity that occurs under your account
  • Promptly notifying us at legal@safetykit.io if you suspect unauthorized access

You may not share your account credentials with others or create accounts on behalf of third parties without authorization.

4. Subscriptions and Billing

SafetyKit offers both free and paid subscription tiers.

  • Billing cycle: Paid subscriptions are billed monthly or annually in advance. Your subscription renews automatically at the end of each billing period unless cancelled.
  • Payment processor: All payments are processed by Stripe, Inc. By subscribing, you authorize Stripe to charge your payment method on a recurring basis. Stripe's Privacy Policy and Terms govern payment processing.
  • Price changes: We may change subscription prices with at least 30 days' advance notice. Continued use after the effective date constitutes acceptance of the new price.
  • Taxes: Prices are exclusive of applicable taxes (e.g., VAT). EU customers will be charged VAT at the applicable rate via Stripe Tax.
  • Failed payments: If a payment fails, we will attempt to notify you and retry. After repeated failures, your account may be downgraded to the free tier.

5. Cancellation

You may cancel your subscription at any time from your account dashboard (Settings → Subscription → Cancel Subscription).

  • Cancellation takes effect at the end of your current billing period. You retain full access to paid features until that date.
  • After cancellation, your account is downgraded to the free tier (if available) or becomes read-only. Your data is retained for 90 days after cancellation before being permanently deleted.
  • EU / Netherlands consumers: In accordance with Dutch consumer law and the EU Consumer Rights Directive, you have the right to cancel at any time via the cancellation button in your account settings. If you have not used the Service and cancel within 14 days of purchase, you may be entitled to a full refund. By activating your subscription and using the Service, you expressly consent to immediate performance and acknowledge the loss of the 14-day withdrawal right.

6. Refund Policy

We offer a 14-day money-back guarantee on new subscriptions and annual renewals. To request a refund:

  • Email legal@safetykit.io within 14 days of your purchase or renewal with your account email and reason for the refund request.
  • Monthly subscriptions: no partial refunds after the 14-day window.
  • Annual subscriptions: pro-rata refunds may be issued at our discretion within 30 days of renewal.
  • EU consumers who have not used the Service may exercise their statutory 14-day withdrawal right for a full refund.

Approved refunds are processed via the original payment method within 5-10 business days.

7. User Responsibilities

You agree to use SafetyKit in compliance with applicable law. You will not:

  • Use the Service for any unlawful or fraudulent purpose
  • Attempt to gain unauthorized access to our systems or other accounts
  • Interfere with or disrupt the Service or its infrastructure
  • Scrape, harvest, or automate access to the Service without prior written consent
  • Upload or transmit viruses, malware, or other harmful code
  • Reverse-engineer, decompile, or disassemble any part of the Service
  • Resell or sublicense access to the Service without our written permission

Documents and outputs generated by SafetyKit tools are templates and starting points for administrative tracking only. They are not a substitute for professional safety engineering advice. You are responsible for reviewing, customizing, and ensuring that any output meets your specific requirements. Consult qualified safety professionals before relying on generated documents for safety-critical decisions.

8. Intellectual Property

Your content: Documents and data you create using SafetyKit remain your property. By using the Service, you grant us a limited license to store and process your content solely to provide the Service to you.

Our platform: SafetyKit and its licensors retain all rights, title, and interest in the Service, including all software, designs, templates, logos, trademarks, and other materials. You may not reproduce, modify, or create derivative works from our platform without our prior written permission.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. OUTPUT GENERATED BY SafetyKit TOOLS IS FOR ADMINISTRATIVE TRACKING AND TEMPLATE PURPOSES ONLY AND DOES NOT CONSTITUTE PROFESSIONAL SAFETY ENGINEERING ADVICE.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SAFETYKIT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.

Nothing in these Terms limits liability that cannot be limited under applicable law (e.g., liability for death or personal injury caused by negligence, or for fraud).

11. Indemnification

You agree to indemnify, defend, and hold harmless SafetyKit and its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of: (a) your use of the Service; (b) your violation of these Terms or applicable law; or (c) your violation of any third-party rights.

12. Governing Law

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict of law principles. Any dispute shall be subject to the exclusive jurisdiction of state and federal courts in Delaware. You consent to personal jurisdiction in such courts.

If you are a consumer in the EU or UK, you also have the right to bring claims before the courts of your country of residence, and EU consumer protection laws that cannot be contractually waived continue to apply.
